Data protection act.

The content of this site is cover by the Data Protection Act, Trendale Limited maintain a register of individuals that receive and undertake responsibility for the correct use of the database within their organisation.

It is also a requirement of the Act that you confirm your agreement to the conditions below regarding the use of the database before we can provide you access to the INDEX database.



Use and ownership

The user/subscriber/organisation agrees that on being supplied access to the INDEX database of specifiers and buyers they/you will undertake to use this only for sales of products or services marketed by the user/organisation granted access to the data. The user/organisation understands that the INDEX database in its entirety can be accessed locally, but undertake that the digital information supplied will not be incorporated into any other digital or physical systems.

The user/subscriber/organisation undertakes that the digital information supplied will not be copied or distributed to third parties other than those involved in the sale of products and services of the user/organisation granted access to the data. Where it is supplied to sales agents or others they/you will obtain signed confirmation from a responsible individual within that company (director or senior executive) that it will not be used for other products/services they may market. The user/organisation accepts that the responsibility of its use will still, however, remains with the original user/organisation. The user/organisation agrees that the INDEX database is supplied as part of their ongoing subscription to the H & V INDEX and that should this subscription be cancelled the INDEX database will no longer be used by user/organisation.

Limitations of use

The user/subscriber/organisation is allowed to use data supplied by Trendale Limited ONLY for uses in relation to activities for the company, subsidiary or agents of the subscribing company. The databases are protected by Copyright and The Data Protection Act and can only be used whilst the Company to whom Data they were originally supplied remains a subscriber to H & V INDEX Marketing Services.



The contract between us

We must receive payment of the whole of the price for the goods or services that you order before access can be granted. Once payment has been received by us we will confirm that your order has been accepted by sending an email to you at the email address you provide in your order form. Our acceptance of your order brings into existence a legally binding contract between us.



Liability

SAVE AS PRECLUDED BY ANY APPLICABLE LAW, WE WILL NOT BE LIABLE TO YOU FOR ANY LOSS OF PROFITS, BUSINESS OR GOODWILL OR ANY INDIRECT OR CONSEQUENTIAL LOSS, DAMAGE OR EXPENSES HOWSOEVER ARISING OUT OF ANY PROBLEM YOU NOTIFY TO US UNDER THIS CONDITION AND WE SHALL HAVE NO LIABILITY TO PAY ANY MONEY TO YOU BY WAY OF COMPENSATION OTHER THAN TO REFUND TO YOU THE AMOUNT PAID BY YOU FOR THE GOODS OR SERVICES IN QUESTION.



Notices

Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our contact address at Trendale Limited, Unit 3, 122 High Street, Purley, CR8 3L, UK and all notices from us to you will be displayed on our website from to time or sent to you by email.



Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.



Third party rights

Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.



Governing law

The contract between us shall be governed by and interpreted in all respects in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.
